General Terms and Conditions for the Purchase of Vouchers

1. General Terms and Conditions for the Online Purchase of Vouchers

1.1 These General Terms and Conditions govern the sale of a distance contract of Familienhotels Südtirol Vouchers, which can be purchased online on the Website www.familienhotels.com.

1.2 The owner of the Website and Seller is Familienhotels Südtirol Genossenschaft – Familienhotels Südtirol Genossenschaft with registered office at Strada Satzl 4, Bressanone (BZ), Italy, VAT no./tax no. 01650890211.

2. Definitions

2.1 For the purposes of these General Terms and Conditions, the following definitions apply:

  • Voucher/Gift Card: the non-personalised shopping Voucher, which can be used exclusively for the purchase of goods and/or services expressly and directly offered on our Website;
  • Seller: Familienhotels Südtirol Genossenschaft – Familienhotels Südtirol Genossenschaft with registered office at Strada Satzl 4, Bressanone (BZ), Italy, VAT no./tax no. 01650890211;
  • Buyer: the person who orders and purchases the Voucher. The data required to identify the Buyer are listed in the “Information about the Buyer” section requested during the Voucher ordering process;
  • Beneficiary: the natural person to whom the Buyer gifts the Voucher;
  • Familienhotels: the Familienhotels Südtirol expressly listed on the Website, where the Vouchers can be redeemed; 
  • Website: the website www.familienhotels.com;
  • Consumer Protection Code: Legislative Decree No. 206/2005;
  • Terms and Conditions: the present General Terms and Conditions.

3. Conditions of Purchase and Subject Matter of the Contract

3.1 The contract is concluded between the Buyer and the Seller and becomes effective once successful payment for the Voucher has been confirmed. By purchasing the Voucher, the Buyer accepts these General Terms and Conditions.

4. Order and Payment

4.1 The Voucher is ordered electronically through the Seller’s Website and paid for by credit card or bank transfer. The Buyer declares that the data provided when ordering and purchasing the Voucher are correct and truthful. It is strictly prohibited for the Buyer to provide false, and/or invented, and/or fictitious, and/or third-party data when filling in the order form.

4.2 The purchased Voucher will be sent to the Buyer in digital form by e-mail to the address provided by the Buyer in the “Information about the Buyer” section of the order. It can be printed out immediately. By selecting the appropriate option during the order process, the Buyer can also request to receive the purchased Voucher in physical form via postal delivery.

4.3 The Voucher is issued with a unique numerical code that can only be used once and is required to redeem the Voucher. The Buyer and/or Beneficiary are expressly informed and acknowledge that possession of the unique Voucher code allows anyone to use the Voucher at the Familienhotels Südtirol. Therefore, this numerical code must be kept securely by the Buyer or the Beneficiary to whom it was given.

4.4 The Buyer and/or the Beneficiary are responsible for the safekeeping and proper use of the original Voucher. The Seller assumes no liability for any misuse of the Voucher. The Seller is not responsible for loss, theft, damage, destruction, cancellation, or misuse of the Voucher: the Voucher cannot be blocked, replaced, or refunded, not even by issuing a new Voucher. Any Voucher obtained through fraudulent or illegal means will be considered void, ineffective, and ineligible for the purchase of goods and/or services offered on the Website. The Seller reserves the right to claim damages in such cases.

5. Prices and Products

5.1 The purchased or ordered Voucher cannot be redeemed for cash, either fully or partially, does not entitle the holder to partial cash payments, and cannot be used to purchase another Voucher.

5.2 If the redeemed value of the Voucher is less than its total amount, the holder will receive an updated Voucher reflecting the remaining balance. A receipt for the adjusted amount will be sent to the Buyer immediately after payment. The Seller accepts no liability for postal delivery delays. The Voucher is only valid if full payment has been made and confirmed. The validity period of the Voucher is one year from the date of issue. Once expired, the Voucher can no longer be used or redeemed, even if it has not been used in full or partially.

5.3 The items and packaging may change during the validity period and/or deviate from the details stated on the Voucher.

6. Use of the Voucher

6.1 Once the purchase has been completed, the Voucher will be sent to the Buyer, either electronically by e-mail or physically by post, depending on the option selected during the order process. The Buyer may use the Voucher personally or gift it to a Beneficiary. In the latter case, it is the Buyer’s responsibility to inform the Beneficiary of the applicable Terms and Conditions, which are published and accessible on the Website.

6.2 The Voucher is a bearer instrument, not issued in a specific name, and cannot be recharged. It is non-transferable and intended exclusively for the personal use of the Buyer or the Beneficiary.

6.3 The holder of the Voucher is the person – either the Buyer or the Beneficiary – who first uses it, even partially (see clauses 4.3 and 5.2).

6.4 In accordance with clause 4.3 of these Terms and Conditions, the Buyer and the Beneficiary are expressly informed that the Voucher is issued with a unique numerical code that can only be used once. Possession and use of this unique numerical code allow the Voucher to be redeemed in whole or in part; afterwards, it can no longer be used. If the value redeemed is less than the total value of the Voucher, the holder will receive an updated Voucher reflecting the remaining balance, as described in clause 5.2.

6.5 The Seller and Familienhotels cannot be held liable if the person using the Voucher, which is a non-personalised bearer instrument, is not the Buyer or the Beneficiary (see clauses 4.3, 4.4, 6.2, 6.3).

7. Right of Cancellation

7.1 Only the Buyer (not the Beneficiary) has the right to cancel the Voucher within 14 days of the date of issue, by providing written notice to the Seller in accordance with Article 52 of the Consumer Protection Code. If the Voucher has been redeemed, either fully or partially, within this 14-day period from the issue date, the right of cancellation is void (see clause 5.2).

8. Data Protection

8.1 The Buyer acknowledges responsibility for providing their personal data and, if applicable, the name of the Beneficiary during the electronic order process. By purchasing the Voucher, the Buyer implicitly accepts this condition. Data Controller
We would like to inform you that the processing of your personal data within the meaning of Regulation (EU) 679/2016 ("GDPR") is carried out by Familienhotels Genossenschaft, located at 4 Satzlstraße, 39042 Bressanone, as the controller ("Controller"), in order to enable the purchase of vouchers on the website www.familienhotels.com.

Types of processed data
The Controller processes personal data within the meaning of Art. 4(1) GDPR, which are collected when concluding and fulfilling the respective contract, such as your name, mobile number, address, email address, payment information, and general contact details, hereinafter referred to as "personal data."

Purpose, Legal Basis, and Voluntary Nature of Processing
Your personal data will be processed - with your explicit consent, if required - for the following purposes:

  • Provision of contractually agreed services, processing of any information or assistance requests, performance of activities related to the company's business operations (such as filling out internal statistics, invoicing, accounting, protection of receivables, and management of liabilities) [Legal basis according to Art. 6(1)(b) GDPR];
  • Compliance with legal, accounting, and tax obligations [Legal basis according to Art. 6(1)(c) GDPR].

Providing your personal data for the above purposes is voluntary; without this information, it will not be possible for us to conclude or fulfill the contract.

Recipients and Transfer of Personal Data
Your personal data may be shared with the following categories of recipients:

  • Natural persons authorized by the Controller after concluding a confidentiality agreement for the processing of personal data (e.g., employees and system administrators);
  • Advisors and banks for accounting and administrative purposes, chambers of commerce, and similar entities, if the transmission is necessary or expedient for carrying out the requested activity, which usually act as data processors for the Controller;
  • Providers of credit card services acting as autonomous controllers;
  • Providers of customer support services acting as data processors in accordance with Art. 28 GDPR;
  • Persons, institutions, or authorities to whom your personal data must be transmitted in accordance with legal provisions or administrative orders.

Storage of Your Personal Data
Your personal data will only be stored for the period necessary to provide the planned services. Excluded from this are longer retention periods provided for in applicable legal regulations, including those of Art. 2946 of the Civil Code. For further information, please contact the Controller.

Your Rights
You have the right to obtain information from the Controller at any time about the processing of your personal data, to request rectification or erasure of the data, or to object to its processing. You also have the right to request restriction of processing in cases provided for by Art. 18 GDPR and the right to receive the data in cases provided for by Art. 20 GDPR in a structured, commonly used, and machine-readable format. Corresponding requests to the Controller can be sent to the following address: info@familienhotels.com.

In any case, you have the right, in accordance with Art. 77 GDPR, to lodge a complaint with the competent supervisory authority (for Italy: Garante per la protezione dei dati personali) if you believe that the processing of your personal data violates applicable legal regulations.
